The processing of personal data, such as the name, address, e-mail address, or telephone number of a data subject shall always be in line with the General Data Protection Regulation (GDPR) and in accordance with the country-specific data protection regulations applicable to Home Philosophy.

As the controller, Home Philosophy has implemented technical and organisational measures to ensure the most complete protection of personal data processed through this website. However, Internet-based data transmissions may in principle have security gaps, so absolute protection may not be guaranteed. For this reason, every data subject is free to transfer personal data to us via alternative means, e.g. by telephone.

1. Hosting and server log files

This website is hosted by Cloudflare, Inc. (Cloudflare Pages). When you visit the site, Cloudflare processes technical connection data (such as IP address, browser type, and requested pages) in server log files to deliver the website securely and reliably. We draw no conclusions about individual visitors from this data. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in the secure operation of the website).

For reach measurement we use Umami, a privacy-friendly analytics tool operated on our own server in the EU. Umami sets no cookies, stores no personal data, does not fingerprint devices, and does not track visitors across websites — which is why no consent banner is required. Legal basis: Art. 6(1)(f) GDPR.

2. Email newsletter (Kit)

If you sign up for our newsletter or request a document (such as a property exposé or cost breakdown), we process your email address via Kit (ConvertKit LLC, USA) to deliver the requested content and, where you have consented, further editorial emails. Sign-up uses double opt-in: you will receive a confirmation email, and no emails are sent until you confirm.

You can unsubscribe at any time via the link in every email. Legal basis: Art. 6(1)(a) GDPR (consent). Data transfer to the USA is safeguarded by the EU-U.S. Data Privacy Framework and standard contractual clauses.

When you request a specific property exposé, we note which property you were interested in so we can follow up meaningfully.

Ordering a property exposé concludes a brokerage agreement (Maklervertrag) with us. To document this agreement we additionally process your first and last name, the property concerned, and the version and timestamp of the declarations you accepted (including your consent to immediate performance under § 356(4) BGB). Legal basis: Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(c) GDPR (statutory documentation duties). This record is retained for the statutory retention periods.

3. Consultation booking (Calendly)

Consultations are booked via Calendly LLC (USA). When you book, Calendly processes the data you enter (name, email, and your answers to the booking questions). We link to Calendly rather than embedding it, so no Calendly cookies are set on this website. Legal basis: Art. 6(1)(b) GDPR (steps prior to entering into a contract).

4. Instagram

This website links to our Instagram profile. We do not embed Instagram components; no data is transferred to Meta by simply visiting this website. If you follow the link, Instagram’s own privacy policy applies.

5. Routine erasure and blocking of personal data

The data controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject.

The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfilment of the contract or the initiation of a contract.

6. Your rights

You have the right to obtain confirmation as to whether personal data concerning you is being processed, to access that data free of charge, and to receive a copy of it (Art. 15 GDPR). You further have the right to rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), and to object to processing (Art. 21).

Where processing is based on consent, you may withdraw that consent at any time with effect for the future. You also have the right to lodge a complaint with a supervisory authority, in particular the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit).
